Principal Magistrate Rose Ndombi reaffirmed Waititu’s earlier bond terms during Tuesday’s session. She made it clear that no amount of persuasion would override the High Court’s earlier ruling that tied the former governor’s freedom to a Ksh53 million bank guarantee.

She said the court had no objection to releasing him on previous terms, but only if he complied with the financial requirement already set by the High Court. The message was firm. The court would not lower the bar.

Waititu told the court that arrangements were in place for a third party to deposit the guarantee on his behalf. He did not name the person. The court did not press him for details. But the instruction remained. No payment, no release.

The offensive conduct case and the hate speech case hanging over Waititu continue to run concurrently. Even with the potential release, his earlier bond conditions in the hate speech case remain fully active.

The next hearing is set for January 15, 2026, marking a long road ahead for the embattled politician.

His legal fight intensified last month after the High Court rejected his third bid to revise the bank guarantee term. Justice Lucy Njuguna dismissed his request to substitute the guarantee with a cash deposit. She warned him that constant reviews would delay the appeal and hinder progress.

Her earlier ruling gave Waititu 120 days to meet the financial requirement, and she barred fresh applications to modify the terms.

Waititu’s conviction in February placed him at the center of a major corruption scandal. He was accused of failing to safeguard public funds after he allegedly received Ksh25 million from a company through an unlawful tender award. The same conviction left him with two options: pay Ksh53.5 million or serve 12 years in prison.

His legal team gambled on bond review applications. They lost.
